Notice of Default

Section 23 of the Act outlines entry conditions and notice requirements. It is an offence under the Residential Tenancies Act to contravene this section.

A landlord can enter any premise during a tenancy, provided the entry is in compliance with the Residential Tenancies Act. It is recommended that landlords conduct regular inspections of their property, at least every three months. Tenants should be advised of this prior to taking possession of the premises. This practice on the part of prudent landlords will likely prevent the premises from being used for illegal activity, and will afford the landlord the opportunity to ensure that the premises are being well maintained, as well as enabling any necessary repairs to be carried out.
