Notice of Default

Landlords can issue a Notice of Default to tenants who are late with their rent. This type of notice can be served on the tenant immediately following the day the rent was due and not paid. The Notice of Default advises the tenant that they are in arrears in their rent and generally gives them a set time period in which to pay the rent (perhaps another day or two). If the rent is not paid by that time the landlord can take other action with no further notice to the tenant. The use of a Notice of Default does not terminate the tenancy.

In the event that the landlord proceeds to court to terminate the tenancy, this documentation will form part of the evidence presented. It assists in demonstrating reasonableness and fairness on the part of the landlord.
