Statement of Account

Landlords must return the security deposit, with interest, within 10 days of the tenant moving out and returning the keys (giving up possession see section 1(4) of the Residential Tenancies Act). This money must be returned personally, or by regular mail or registered mail, or delivered in any other manner agreed to in writing by the landlord and tenant. The landlord has the right to make deductions for damages and can either:

1. Return the balance of the deposit to the tenant with a statement that lists the damages, repair costs, and cleaning charges, or

2. Give the tenant an estimate of deductions that will be made and return money that will not be used. Within 30 days of the tenant giving up possession, the landlord must provide the tenant with a final statement and the balance of any money that is owed.

If the landlord does not return all or part of the security deposit, or if the tenant disagrees with the landlord’s statement of account, the tenant can take action against the landlord for the amount owed, either by filing a complaint with Service Alberta – Consumer Services, or by going to court.
